Terms of Service

Wheeler’s Fitness Equipment Company Incorporated (“Wheeler’s”) has the right to refuse any order.

Prices and models subject to change without notice.

Consult your physician before beginning any exercise program.

Orders/changes/cancellations:

If you have questions about placing an order, please contact us before you place the order. Once an order is placed you have 30 minutes to make any changes. A 20% restocking fee will be applied to all cancelled orders in progress whether or not the order has been shipped.

All orders are screened for fraud. If an order meets our criteria for fraud prevention, your order may be delayed or denied at our discretion.

Sorry, we do not accept international orders at this time.

Payment options:

Visa, MasterCard, Discover, Cashier’s check, Money Order, and personal checks*. No purchase orders will be accepted on this website. No C.O.D.’s

*personal checks must be imprinted with your name, address, and phone. No two-party checks are accepted. Allow 14-21 days for out of area checks to clear, 7-12 days for local checks. Local checks are accepted in the store with a “no-waiting” policy for any purchase of $100 or LESS. Purchases over $100 must allow for the 7-12 day clearance before the merchandise may be picked up or delivered. A $45 return check fee will be added to all bad checks.

Delivery times and methods:

Normal delivery time is 10-14 business days from date of order, not including holidays or weekends. This time can vary around holidays and peak shopping times during the year. Most orders are shipped either by UPS, FedEx, or common carrier. We do not ship to PO Boxes, APO’s, or FPO’s.

We require two contact phone numbers with your order so delivery companies may be able to contact you if needed prior to delivery. You must be present on the scheduled delivery date. Any re-deliveries, re-routing or storage charges are 100% the customer’s responsibility. Wheeler’s will not re-route a delivery under any circumstances. If an order is returned because it was not deliverable per your original instructions, you will be charged shipping both ways plus a 25% restocking fee.

Orders are shipped as straight deliveries unless otherwise arranged and paid for prior to shipping. The carrier will deliver to the back of the truck—if common carrier is used—and it is the responsibility of the recipient to remove the freight from the truck and move it to its final destination. Any additional services such as, but not limited to, lift-gate service, inside delivery, or assembly must be pre-arranged and paid for prior to shipping.

When the shipment arrives, count the total number of pieces received and inspect for damage, noting any discrepancies on the freight receipt. Failure to do so voids any liability of Wheeler’s or the carrier. Any and all claims for damage or shortages must be filed with the carrier.

Freight carriers may not have normal access to certain areas. In these events you will be contacted by Wheeler’s for possible additional service charges prior to shipping.

Receiving a shipment/Refusal of Delivery/Undeliverable shipments:

If your order is refused or undeliverable, the cost of shipping both ways plus a 25% restocking fee will be subtracted from your refund if one is requested. This includes items shipped with “free freight” promotions. Upon arrival, make note on the freight bill of any damages to any boxes or containers prior to signing for the shipment. It is also recommended that you take pictures of damaged boxes for filing a freight claim later if needed.

Count the number of boxes received and verify that it matches exactly the number of boxes on the freight bill. When you sign for your shipment, you are indicating that all packages on the receipt are counted and in good condition. If this is not the case, make note as previously instructed and have the driver initial the freight bill. In the event of a refund, failure to follow these procedures could void any refunds in their entirety.

Free freight and shipping included:

If “free shipping or shipping included” is offered on a purchase and you refuse delivery or a shipment is not deliverable according to the information you have provided and the shipment returns to us or one of our vendors, you will be responsible for freight costs both ways. These costs might be higher than the original shipping charges that we paid to ship the product to you.

If you wish to have an order re-shipped, the freight must be pre-paid as indicated. If you wish to cancel the order, the freight (both ways), plus a 25% restocking charge will be subtracted from any refunds due.

Sales tax:

California orders will be charged the applicable sales tax.

Sales and promotions:

Wheeler’s reserves the right to cancel any sale or promotion at any time without prior notice.

Damages and shortages:

Damaged shipments and shortages must be reported to Wheeler’s within 24 hours of receipt. Inspect your order when it is received and make note of any damages or shortages on the freight bill and have the driver initial. (Example: If the freight bill says 6 boxes total, you must have 6 boxes. If a box is crushed or ripped open, note that specifically on the bill.) Failure to do so may result in a claim being denied.

Keep all original boxes, cartons, containers, packaging, and merchandise as received. Damage claims must be filed with the freight carrier before we can replace lost or damaged merchandise. We will replace or repair, at our discretion, items damaged in shipping but a freight claim must be filed before this will be done. Unless a proper claim is filed, no damaged goods will be replaced or repaired after 10 days of receipt of order. It is the customer’s responsibility to file these claims immediately.

Backorders:

Most items are available for immediate shipment most of the time but occasionally backorders do occur. Wheeler’s shall not be held responsible or liable for backorders but shall ship the order as soon as it becomes available. We attempt to note backorders on our website as soon as we are aware of them however; we are not responsible for delays by our vendors. An order cancelled due to a backorder will be charged a 20% restocking fee plus shipping both ways if the order has been shipped prior to cancellation.

Product changes:

Wheeler’s shall not be held responsible for manufacturing product changes such as, but not limited to, color, size, shape, or specific function of a product it has advertised on its website. Nor shall Wheeler’s be held responsible for items that have been discontinued or model changed. If you order an item that has been discontinued and not replaced with a newer version/model, you shall receive a full refund on your order.

Warranty:

There shall be no warranty assumed or implied other than those provided by the manufacturer of any product sold on Wheeler’s website. Some items may require that the customer contact the manufacturer directly for warranty or service claims. Wheeler’s will gladly assist in directing the customer in this regard. Unless a product is specifically rated for commercial use, it shall have no warranty coverage within a commercial or institutional environment including, but not limited to: schools, corporate or government fitness centers, multi-unit complexes such as apartments and condominiums, or pay for use facilities such as public gyms or private training studios. Equipment installed in these types of facilities without a commercial warranty has no warranty, implied or otherwise.

Returns/Refunds:

All items sold online by Wheeler’s are covered by a 10 day return policy. A customer must notify us in writing within the 10 day period beginning the day the shipment is delivered. No item may be returned without authorization. Items must be returned within 10 days of receiving authorization. The product(s) must be returned in full (all attachments, accessories, etc.), in the original container re-packed in the original packaging. Do not write on the box; be sure to use shipping labels. For example: If an item arrived strapped to a pallet by a freight company, it must be returned strapped to a pallet by a freight company. The customer is responsible to re-package and contact the shipper to arrange the return. There will be a 20% restocking fee imposed on all returns in addition to shipping charges both ways. The actual shipping charges may be higher to the amount originally charged to the customer due to vendor’s pre-negotiated terms with the freight company. This applies even if the original purchase included “free shipping”.

The 20% restocking fee and shipping costs will be deducted from the refund amount. No refund will be issue until the item/package is received back and inspected. Any damage, missing parts or improper returns will be assessed and deducted from the refund amount due. A refund will be issued only to the original method of payment.
